1. Agreement to Terms

By accessing or using ChickenDuck ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the Service.

"ChickenDuck," "we," "us," and "our" refer to ChickenDuck and its operator. "You" refers to you, the user.

2. Description of Service

ChickenDuck is a language learning tool that provides:

• Real-time transcription of language tutoring sessions
• AI-powered vocabulary detection and suggestions
• Flashcard creation and spaced repetition review
• File vocabulary extraction
• Lesson history and progress tracking

Features may vary by subscription plan. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration

To use ChickenDuck, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

You must be at least 13 years old to use ChickenDuck. If you're under 18, you should have parental consent.

4. Subscriptions and Payments

Free Plan

ChickenDuck offers a free plan with limited features. No payment information is required for the free plan.

Paid Plans

Paid subscriptions are billed monthly or annually, depending on your selection. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Price Changes

We may change subscription prices with 30 days' notice. Price changes won't affect your current billing period.

Refunds

We offer a 14-day money-back guarantee for new subscriptions. If you're not satisfied, contact us within 14 days for a full refund. After 14 days, refunds are at our discretion.

Cancellation

You can cancel your subscription anytime from Settings > Subscription. You'll retain access to paid features until the end of your current billing period.

5. Your Content

"Your Content" includes transcripts, flashcards, vocabulary, and any other data you create or upload to ChickenDuck.

• Ownership: You retain ownership of Your Content
• License: You grant us a limited license to store, process, and display Your Content solely to provide the Service
• Responsibility: You're responsible for Your Content and ensuring you have rights to any uploaded materials

6. Acceptable Use

You agree not to:

• Use ChickenDuck for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated tools to scrape or extract data
• Share your account with others (except Tutor plan student accounts)
• Resell or redistribute the Service
• Upload malicious content or violate others' rights

Recording Consent Warranty: You represent and warrant that you have obtained all necessary consents, permissions, and authorizations from all participants (including tutors/students) before initiating any recording through the Service. You agree that ChickenDuck is merely a processor of the data you provide and that you are solely responsible for complying with all applicable recording and privacy laws in your jurisdiction and the jurisdiction of other participants.

Prohibited Content: You may not use the Service to record or transcribe conversations for malicious, non-educational, or unauthorized commercial purposes.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

ChickenDuck, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. These Terms don't grant you any rights to our intellectual property except the limited right to use the Service as intended.

8. Third-Party Services

ChickenDuck integrates with third-party services (video calling platforms, speech-to-text providers, etc.). Your use of these services is subject to their own terms. We're not responsible for third-party services.

9. Disclaimer of Warranties

ChickenDuck is provided "as is" and "as available" without warranties of any kind, express or implied. We don't guarantee that:

• The Service will be uninterrupted or error-free
• Transcriptions will be 100% accurate
• AI suggestions will always be correct
• The Service will meet your specific requirements

We do our best to provide a reliable, accurate service, but language and speech processing are complex and imperfect.

AI-generated outputs, including transcriptions and vocabulary suggestions, are generated by experimental technology and may be inaccurate, incomplete, or inappropriate. ChickenDuck does not guarantee the accuracy of any AI output. You agree to use such outputs at your own risk and are solely responsible for verifying their accuracy before use.

10. Limitation of Liability

To the maximum extent permitted by law, ChickenDuck and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ChickenDuck and its operator from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance.

13. Termination

You may terminate your account at any time. We may terminate or suspend your account for violation of these Terms or for any other reason with notice. Upon termination, your right to use the Service ends immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the courts of Singapore.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
